Why do I need a Will?
A Will is the only way to ensure your assets go where you want them to go.
Without a Will then the Laws of Intestacy will apply.
What is an Executor?
An Executor is the person nominated in a Will to carry out your directions.
The Executor is legally responsible for completing the probate process and obtaining the Grant.
The Executor's duties include obtaining the estate information, collection and arranging for payment of debts, completing necessary forms, ensuring tax is paid and distributing the assetts according to the Will.
What is Probate?
It is a process that Executors will follow, sometimes referred to administering the estate, before applying for the Grant of Probate.
This process can be complicated and take several months to complete.
There are forms to be filed and non-professional Executors will need to attend a court hearing to obtain the Grant.
